Driving a car is almost like a habit, once you get used to the car that you're driving and the street that you hit more than a thousand times.
I would like to introduce you to some of the vehicle-related crimes punishable by the law in Korea. Once you're on the road, driving a car, there is social norm that we need to follow, and you must note that your bad habit can turn into crimes all of sudden with fatal casualties.
- Gross Negligence(ACT ON SPECIAL CASES CONCERNING THE SETTLEMENT OF TRAFFIC ACCIDENTS, Article 3, Criminal Act Article 268) imprisonment without prison labor for not more than five years or by a fine not exceeding 20 million won
- Hit and Run((Act on the Aggravated Punishment, Etc. Of Specific Crimes, Article 5-3), en victim dies(imprisonment with labor for an indefinite term or by imprisonment with labor for not less than five years) hen victim had been injured( imprisonment with labor for a limited term of not less than one year or by a fine of not less than 5 million won but not more than 30 million won)
- Driving Under Influence(Road Traffic Act, Article 44, Article 148-2)
1. A person whose blood alcohol content is not less than 0.2 percent shall be punished by imprisonment with labor for not less than 2 years but not more than 5 years or by a fine not less than 10 million won but not exceeding 20 million won;
2. A person whose blood alcohol content is not less than 0.08 percent but less than 0.2 percent shall be punished by imprisonment with labor for not less than 1 year but not more than 2 years or a by fine not less than 5 million won but not exceeding 10 million won;
3. A person whose blood alcohol content is not less than 0.03 percent but less than 0.08 percent shall be punished by imprisonment with labor for not more than 1 year or a by fine not exceeding 5 million won.
- Diving with no Driver’s License(Road Traffic Act, Article 152) Imprisonment with labor for not more than one year or by a fine not exceeding three million won.
- Dangerous Diving(Act on the Aggravated Punishment, Etc. Of Specific Crimes, Article 5-11) “By driving a motor vehicle (including a motorcycle) while ability impaired by the influence of alcohol or drugs, a person who causes injury to any other person shall be punished by imprisonment with labor for not more than 15 years or by a fine of not less than 10 million won but not more than 30 million won, or a person who causes death of any other person shall be punished by imprisonment with labor for a definite term or not less than three years, respectively. <Amended by Act No. 15981, Dec. 18, 2018>
