As a criminal defense lawyer with 8 years of experience, I have to alert you with this unbelievable fact, ‘It can happen to you’
The reason why I chose this topic once again is to let you know that you should be well prepared for your wrongfully-charged(alleged) crime while thinking the possibility to press charge that person(who wrongfully accused you for a crime) after you clear your charge.
Korean Criminal Act, Article 156(False Accusation) defines ‘False Accusation’ as,
A person who reports false information to a public office or a public official for the purpose of having a criminal or disciplinary punishment imposed upon another, shall be punished by imprisonment for not more than ten years, or a fine not exceeding 15 million won. <Amended by Act No. 5057, Dec. 29, 1995>
Falsely accusing of someone can be happening in different types of cases and situations, including criminal cases, a civil lawsuit, and even in personal or professional relationship.
Among those various types of false accusation, what makes the criminal case is whether the accuser accused you of crime(such as theft, Assault, Drug possession, Child abuse, Sexual assault) that is punishable by the criminal law or disciplinary code of certain organization, to a person who has a right to receive those complaint officially or not.
Once you are well prepared for your investigation, stories get to be unfold towards the right direction, and lies will be detected along the way.
You are in a danger of being found gulity when you’re not, and your whole life will be ruined and interrupted by investigation, and people around you will start to look at you differently once the rumor gets to go around the town.
In that regards, false accusation is a serious crime, and the convicted gets to held in prison according to the final verdict quite often. Your reputation have been ruined, your ordinary life have been interrupted quite seriously. What happened is happened, can’t help it. But you can restore your reputation by pressing charge of someone who wrongfully charged you of the crime.
